1. Par mums
Mūsu redzējums ir iedvesmot pārmaiņas veselības sistēmā, nodrošinot personalizētu ādas veselības aprūpi. Lai nodrošinātu visaugstāko medicīniskās aprūpes kvalitāti, mūsu licencētie dermatologi un programmatūra proaktīvi uzrauga mūsu lietotāju veselību. Visi veselības dati tiks glabāti jūsu veselības uzskaitē. Mūsu pieeja ir balstīta uz Vispārīgo datu aizsardzības regulu (GDPR) (6. panta 1.b punkts un 9. panta 1.h punkts), kurā teikts, ka datu apstrāde ir nepieciešama profilaktiskās veselības aprūpes, medicīniskās diagnostikas, veselības aprūpes pakalpojumu sniegšanas, ārstēšanas vai veselības aprūpes sistēmu un pakalpojumu pārvaldības nolūkos.
Izmantojot mūsu platformu, jūs piekrītat un apzināties, ka jūsu personas dati un ar pakalpojumu saistītie veselības dati tiks apstrādāti, lai nodrošinātu jums visaugstākās kvalitātes dermatoloģijas pakalpojumus, un visi ar jūsu izmantošanu saistītie dati var tikt glabāti jūsu veselības uzskaitē.
Mūsu ārsti ievēro Vispārīgās medicīniskās padomes vadlīnijas par attālināto izrakstīšanu un Kvalitātes un drošības būtisko standartu izstrādātās vadlīnijas, kā arī viņu prakses valsts prasības.

Jūs varat izlasīt mūsu Privātuma politiku un Sīkdatņu politiku attiecīgajās sadaļās. Šajās politikās ir sniegta informācija par to, kā mēs apstrādājam personas datus, ko mēs paši savācam vai saņemam no jums, kā arī informācija par sīkdatnēm, kas tiek izmantotas mūsu platformā.
4. Reģistrācija
Lai saņemtu konsultāciju ar dermatologu, jums jāreģistrējas konsultācijai iDerma.lv vietnē un jāiesniedz konsultācijas pieprasījums ar jūsu personas datiem.
5. Vecuma ierobežojumi
Mūsu platforma ir paredzēta pacientiem no 18 gadu vecuma. Mums ir tiesības lūgt jums pierādīt jūsu vecumu, pirms apstiprinām jūsu tiesības izmantot mūsu platformu. Pilngadīga persona ar kontu iDerma platformā var pārstāvēt citu pacientu, ja pārstāvības tiesības ir apstiprinātas ar nepieciešamajām pilnvarām (piemēram, Notāra pilnvaru vai pilnvaru e-Veselības platformā) un citiem dokumentiem (piemēram, bērna dzimšanas apliecību, ja konsultācija ir rezervēta bērnam).
Pārstāvot citu personu ar pienācīgi autorizētu pilnvaru, dati, kas iegūti par personām, kuras nav sasniegušas 18 gadu vecumu, tiek uzskatīti par likumīgi savāktiem, un persona, kas sniedz informāciju, ir atbildīga par to, lai viņai būtu visas nepieciešamās pilnvaras, lai pabeigtu konsultāciju citas personas vārdā.
6. Mūsu saistības pret jums
Mēs nodrošinām profesionālu, augstas kvalitātes dermatoloģijas konsultāciju pakalpojumu. Mūsu ārsti un inženieri pastāvīgi izstrādā jaunas programmatūras funkcijas, lai nodrošinātu visaugstāko un labāko iespējamo pakalpojumu kvalitāti, pamatojoties uz jūsu pieprasījuma informāciju, izmantojot jaunākās tehnoloģijas.
Katrs no mūsu ārstiem uzņemas šādas saistības:
a) Profesionālā atbildība: Pilna profesionālā atbildība par katru pacientu, kurš izmanto telemedicīnas pakalpojumus, tāpat kā pacientiem, kuri tiek ārstēti ārsta parastajā profesionālajā vidē.
b) Atbilstība: Profesionāla un pārredzama pakalpojuma sniegšana pilnībā saskaņā ar Vispārīgās medicīniskās padomes vadlīnijām par attālināto izrakstīšanu un saskaņā ar Kvalitātes un drošības būtiskajiem standartiem, Labas medicīniskās prakses un Vadlīnijām, ko izdevusi Kvalitātes nodrošināšanas komisija.
c) Identifikācija: Norādīt savu vārdu un ārsta licences numuru, izrakstot zāles.
d) Zāļu izrakstīšana pacienta interesēs: Izrakstīt zāles tikai tad, ja tas ir vispiemērotākais risinājums pacientam, un atteikties izrakstīt zāles, ja ārsts uzskata, ka šāds izrakstījums nav ieteicams bez kontaktkonsultācijas.
e) Privātums: Veikt saprātīgus pasākumus, lai aizsargātu pacienta sniegtos personas datus vai citu informāciju, kā noteikts mūsu Privātuma un Sīkdatņu politikā.
7. Jūsu pienākumi, izmantojot mūsu pakalpojumus un veicot pasūtījumus
Jūsu pienākumi kā pacientam:
a) Precīza informācija: Sniedziet pareizas un precīzas atbildes uz visiem jautājumiem.
b) Reģistrācija citas personas vārdā: Nekad nereģistrējiet vai neaizpildiet veidlapu citas personas vārdā, ja jums nav autorizācijas to darīt.
c) Atbilstība norādījumiem: Uzmanīgi izlasiet konsultācijas un ārstēšanas ieteikumus pirms sākat ieteikto un izrakstīto ārstēšanu; ievērojiet zāļu lietošanas instrukcijas un jebkurus citus norādījumus, ko saņemat no sava iDerma ārsta; izlasiet iepakojuma lapu un nekad nelietojiet citas zāles bez konsultācijas ar savu ārstu vai farmaceitu. Ja jums ir jautājumi par izrakstītajām zālēm, lūdzu, sazinieties ar mums un nelietojiet zāles, līdz neesat saņēmis pareizu informāciju no mums un saprotat piemērojamos norādījumus.
d) Lēmumi: Pieņemiet iDerma ārstu klīnisko spriedumu, ja viņi nolemj, ka zāles jums nav ieteicamas un ka jums jākonsultējas ar ārstu. iDerma ārsta lēmums ir galīgs un turpmāka korespondence netiks atbildēta.
e) Informēšana par jūsu ģimenes ārstu: Jūsu pienākums ir informēt savu ģimenes ārstu par zālēm, ko izrakstījis jūsu iDerma ārsts, un jums jāglabā informācija par savu ārstēšanu. Lūdzu, ņemiet vērā, ka noteiktos būtiskos gadījumos (piemēram, kad jūsu veselība ir apdraudēta zāļu iespējamās blakusparādības dēļ utt.) mums var būt nepieciešams sazināties ar jūsu ģimenes ārstu vai medicīnas dienestiem bez jūsu piekrišanas.
f) Zāļu aizsardzība: Nodrošiniet, ka tikai jūs varat piekļūt zālēm, ko izrakstījuši iDerma ārsti.
g) Derīguma termiņš: Pārliecinieties, ka nelietojat izrakstītās zāles, ja tām ir beidzies derīguma termiņš.
h) Blakusparādību paziņošana: Informējiet iDerma, izmantojot konsultāciju veidlapu, ja jums rodas jebkādas blakusparādības no lietotajām zālēm vai ja uzskatāt, ka jūsu iDerma ārsta izrakstītās zāles nedarbojas.
8. Informācija un padomi
iDerma ārstu sniegtā informācija un padomi ir balstīti uz jūsu sniegto informāciju. Jūs esat atbildīgs par sniegtās informācijas precizitāti un pilnīgumu, un jūs atzīstat, ka precīzas un pilnīgas informācijas nesniegšana (vai nu apzināti, vai neapzināti) var negatīvi ietekmēt sniegto informāciju un padomus, ko saņemat, kā arī izrakstītās zāles, kurām var būt sekas, par kurām mēs neesam atbildīgi.
Mēs cenšamies atbildēt uz visiem informācijas un padomu pieprasījumiem 24 stundu laikā, no pirmdienas līdz piektdienai, izņemot brīvdienas un svētku dienas. Šādos gadījumos mēs varam atbildēt līdz 48 stundām.
9. Lēmums par zāļu izrakstīšanu
Mūsu ārsti var pieņemt labāko lēmumu par konkrētu zāļu lietošanu jūsu interesēs tikai tad, ja viņiem ir visa pieprasītā informācija. Dažkārt var būt nepieciešams lūgt papildinformāciju, lai papildinātu medicīnas formā sniegtās atbildes. Šim nolūkam ārsts var sazināties ar jums pa (mobilā) tālruni, e-pastu vai pastu.
10. Cenas un maksājumi
Maksājuma valūta būs atkarīga no valsts, no kuras tiek veikts konsultācijas pieprasījums, un tā būs vietējā valūta. Pakalpojumu cena (ieskaitot nodokļus, ja vien nav norādīts citādi) ir cena, kas norādīta pasūtījuma formā, kad jūs piekrītat darījumam par pakalpojumu vai produktu.
Mēs darām visu iespējamo, lai nodrošinātu, ka mūsu platformā norādītās cenas ir precīzas, taču dažkārt var rasties kļūdas. Ja pamanāt kļūdu un ir veikta pārmaksāšana, mēs nodrošināsim, ka klientiem, kuri ir samaksājuši pārāk daudz, tiek atmaksāta starpība.
11. iDerma telemedicīnas pakalpojumu un partneru pakalpojumu kārtība
Mēs sniedzam mūsu konsultācijas (telemedicīnas pakalpojumus), izmantojot programmatūru. Programmatūra palīdz mums veikt sākotnējo jūsu sniegto medicīniskās diagnostikas datu pārbaudi, tiklīdz sniedzat mums pieprasītos datus. Tas nozīmē, ka mūsu ārsti var pieņemt lēmumus, pamatojoties uz automatizētu personas datu apstrādi šim nolūkam un uz konkrētu faktoru novērtējumu, kas saistīti ar jūsu veselību vai uzvedību (profilēšana).
Mēs novērtēsim, vai medicīnas formā sniegtā informācija vai dati no citiem datu avotiem (piemēram, līdzīgi citu pacientu gadījumi, neseni zinātniski publikācijas utt.) un/vai jūsu iepriekšējās konsultācijas ar mums ir skaidrs iemesls, lai jums nesniegtu konkrētu medicīnisko padomu un/vai neizrakstītu zāles, kas jums ir prioritāte kā patērētājam. Tādēļ mēs un mūsu partneri varam novērtēt jūsu gadījumu kā augsta riska medicīnisko konsultāciju un atteikties sniegt padomu vai izrakstīt zāles. Tas notiek, piemēram, ja sniegtā informācija pilnīgi izslēdz konkrētas ārstēšanas vai zāļu izrakstīšanu vai ja ir iemesli uzskatīt, ka medicīniskā informācija var nebūt uzticama. Mēs to darām, lai nodrošinātu jūsu veselības aprūpi vislabākajā iespējamajā veidā. Mūsu procedūras un programmatūra tiek nepārtraukti vērtētas un uzlabotas, pamatojoties uz pašreizējiem veselības aprūpes noteikumiem un zinātniskajiem atklājumiem.
Neskatoties uz šo novērtējumu, ja saņemat automātisku medicīniskā padoma atteikumu, jums ir tiesības nepiekrist lēmumam un izteikt savu pozīciju, sazinoties ar mums. Tad jūsu gadījums tiks atkārtoti novērtēts.
Lai nodrošinātu augstu mūsu telemedicīnas pakalpojumu kvalitāti un garantētu jūsu ērtību un datu drošību, mēs ļausim jums izmantot šādas funkcijas un pakalpojumus:
Veselības konts: Veselības konts ļauj tieši un konfidenciāli sazināties ar jums un tiks izmantots, lai uzglabātu informāciju par jūsu veselību, jūsu medicīniskajām konsultācijām, izrakstītajām zālēm un medicīniskajiem ieteikumiem. Dati tiks savākti tā, lai nodrošinātu to konfidencialitāti.
Medicīniskās vēstures un ierakstu uzturēšana un izpaušana: Mēs vācam informāciju no visām jūsu medicīniskajām konsultācijām, ieskaitot medicīniskās formas, ko iesniedzat, korespondenci ar jums, informāciju par jūsu veselību, jūsu medicīniskajiem ierakstiem un jebkādiem komentāriem un ieteikumiem, ko jūsu ārsts nosūta jums, lai mēs varētu nodrošināt jums vislabāko veselības aprūpi. Mēs arī glabājam konsultāciju pakalpojumu progresu un iznākumu jūsu veselības ierakstā.
Recepšu piegādes pakalpojums: Ja jums ir izrakstīta recepte, jūs varat pasūtīt tās piegādi jums. Šajā gadījumā jums būs jāmaksā ne tikai par medicīnisko padomu, bet arī par recepšu piegādes pakalpojumu.
12. Jūsu tiesības atcelt pakalpojumu un iesniegt sūdzību
12.1. Saskaņā ar šiem noteikumiem jūs varat pārdomāt un atcelt savu konsultācijas pieprasījumu vai pasūtīto produktu un saņemt atmaksu (ar noteiktiem izņēmumiem). Šīs tiesības tiek sauktas par “atteikuma tiesībām” saskaņā ar Patērētāju tiesību aizsardzības likumu un noteikumiem par patērētāju tiesību aizsardzību.
12.2. Jums nav tiesību atcelt pakalpojumus, kas jau ir sniegti vai produktus, kas jau ir piegādāti, ja vien mēs neinformējam jūs citādi. Ja esat izmantojis mūsu pakalpojumus (piemēram, konsultāciju ar dermatologu) un esat saņēmis rezultātus vai ārsta izrakstītās zāles, jūs nevarat atcelt pakalpojumu vai piegādāto produktu vai pieprasīt atmaksu.
12.3. Atteikuma tiesību periodam pakalpojumu atteikšanai jābūt 14 dienām no dienas, kad rezervējāt konsultāciju.
12.4. Ja vēlaties atcelt pakalpojumu un saņemt atmaksu, jums ir jāinformē mūs, nosūtot e-pastu uz [email protected].
12.5. Lai iesniegtu sūdzību par mūsu pakalpojumiem, jūs varat nosūtīt e-pastu uz [email protected], un mēs atbildēsim 48 stundu laikā. Ja jautājums netiek atrisināts, jūs varat to eskalēt Latvijas Patērētāju tiesību aizsardzības centrā.

13. Intelektuālā īpašuma tiesības
13.1. Viss iDerma platformas saturs, ieskaitot tekstu, grafikas, logotipus, attēlus, audio klipus, digitālās lejupielādes un programmatūru, ir iDerma vai tā satura piegādātāju īpašums un ir aizsargāts ar starptautiskajiem autortiesību likumiem.
13.2. Jūs nedrīkstat izvilkt un/vai atkārtoti izmantot daļas no platformas satura bez iDerma skaidras rakstiskas piekrišanas.
14. Atbildības ierobežojums
14.1. Mēs neesam atbildīgi par jebkādiem zaudējumiem vai bojājumiem, ko esam izraisījuši situācijās, kad nav pārkāpts juridisks pienākums pret jums, šādi zaudējumi vai bojājumi nav saprātīgi paredzami rezultāti no šāda pārkāpuma, vai jebkura zaudējumu vai bojājumu palielināšanās rodas no jūsu pārkāpuma šajos noteikumos un nosacījumos.
14.2. Nekas šajos noteikumos un nosacījumos neizslēdz vai neierobežo mūsu atbildību par nāvi vai personīgu savainojumu, kas radies mūsu nolaidības, krāpšanas vai jebkuras citas atbildības, kas nevar tikt izslēgta vai ierobežota ar likumu, rezultātā.
15. Piemērojamie likumi un jurisdikcija
Šie noteikumi un nosacījumi tiek regulēti Latvijas likumiem. Jebkādi strīdi, kas izriet no mūsu pakalpojumu izmantošanas, tiks pakļauti Latvijas tiesu ekskluzīvai jurisdikcijai.
